Procedure for the Receipt of Creative Material
In line with the Television Programme Proposals Code of Practice adopted by the BBC, ITV Network Limited, Channel Four Television,
Channel 5 Broadcasting and the Alliance for Protection of Copyright on 1 April 1999, Angel Eye Media is committed to observing the following
procedures in the receipt and acknowledgement of Creative Material:
Procedures by the Originator:
When presenting Creative Material the Originator should, where possible, ensure the following:
- that Creative Material submitted to angel eye is stated as being submitted in confidence;
- that the Originator retains an exact copy of the Creative Material submitted, and written details of the date of submission, and
the name of the person to whom it was submitted. An Originator may also wish to formally register the documentation at the time of
the submission with a registration or legal representative;
- that Creative Material is in writing and its distinctive and original features are clearly identified.
Procedures by Angel Eye Media:
When receiving Creative Material Angel Eye Media will, where possible, ensure the following:
-
that confidentiality will be observed by Angel Eye in the receipt and appropriate internal review of Creative Material. For
this purpose an Originator should recognise that in the normal course of business Creative Material may need to be copied on
a restricted and confidential basis within the organisation to those responsible for assessing or approving commissioning
work or services based upon Creative Material. Angel Eye will observe any reasonable restrictions on the circulation of
Creative Material which may be specified by or exceptionally agreed with an Originator but in the absence of such agreement
circulation to relevant Individuals will be acceptable practice;
-
that all Creative Material is logged on receipt, by reference to title, date, receiver's name and a brief indicative
description of the nature of the material as soon as practicable;
-
that Angel Eye thereafter provides a fuller response indicating rejection or a wish to continue to consider the Creative
Material (aiming for a time frame of three weeks).
-
if creative material is rejected, Angel Eye will upon request use reasonable endeavours to return any and all original
materials supplied by the Originator.
Development
Where Angel Eye commissions an Originator to undertake development work, specific contractual terms will be agreed to deal with the
ownership of Creative Material and the development work. The terms of any such agreement shall then supersede the relevance of the
Code concerning any
further dealings use of the relevant Creative Material.
